This site describes who we are and what we build. Nothing on it is an offer capable of acceptance, a quotation, or a warranty. Product descriptions reflect the state of a product at the time of writing and may change.
Engagements
Work begins only under a written agreement — a proposal, statement of work, or purchase order signed by both sides. That agreement sets the scope, price, timeline, and payment schedule, and it prevails over anything stated here or on any other page of this site.
We quote fixed scope and fixed price. Changes to an agreed scope are handled as a written change request with their own price and timeline.
White-label delivery
Where we deliver under a partner's brand, we remain unnamed to their client and are bound by the confidentiality terms of the engagement. We do not approach, solicit, or contract with a partner's client directly in connection with that work.
Intellectual property
On full payment, the client owns the deliverables built specifically for them, as set out in the engagement agreement. We retain ownership of our own products, pre-existing tools, libraries, and general know-how, and of anything licensed to us by a third party. Third-party components keep their own licences.
The Sawai Tech name, logo, and the content of this website remain ours.
Client responsibilities
Delivery depends on timely access, decisions, credentials, and third-party accounts from the client. Where a project needs an account with a provider — a payment gateway, the WhatsApp Business API, a cloud host — that account and its fees belong to the client unless the agreement says otherwise.
Warranties and liability
We warrant that work is performed with the reasonable skill and care of a competent engineering team. Beyond that, and to the extent the law allows, deliverables are provided without further warranty. Neither party is liable for indirect or consequential loss, and our total liability under an engagement is limited to the fees paid for it.
We describe compliance work as experience building to a standard's requirements. We are not a certification body and do not claim certification.
Governing law
These terms and any engagement are governed by the laws of India, and the courts at Jodhpur, Rajasthan have exclusive jurisdiction, unless an engagement agreement states otherwise.
